Brian A. Hinton

Partner


Brian Hinton is a partner at Anderson Crawley & Burke. He focuses his practice on construction and commercial litigation, with extensive experience defending insureds in complex, high-exposure matters.

Brian regularly represents contractors, developers, and businesses in construction defect claims, construction site liability cases, and commercial disputes. His broader litigation experience includes insurance coverage and bad-faith claims, trucking and transportation matters, products liability, premises liability, and automobile claims.


In addition to his litigation practice, Brian is a trained mediator and is actively involved in national defense and claims organizations. Through committee work and leadership roles, he frequently provides education and training to claims professionals and industry partners.


Brian also is certified in Civil Trial Law by the National Board of Trial Advocacy, and he serves in national leadership positions within several construction-liability organizations, reflecting a practice that blends trial experience with industry-specific insight.

Representative Matters
  • Successfully obtained partial summary judgment in direct action against national insurance carrier where plaintiff sought recovery of UM benefits previously paid by WC carrier on behalf of insured employer – Neely v. Builders Mutual Insurance Company, No. 1:24-cv-45, 2025 WL 1570976 (N.D. Miss., June 3, 2025);

  • Successfully obtained full dismissal on behalf of residential home builder in suit alleging negligent construction and breach of contract (2024);

  • Successfully obtained full dismissal on behalf of regional HVAC company in suit alleging negligent construction, breach of contract and fraud (2024);

  • Successfully appealed trial court’s order granting summary judgment in favor of ATV driver where genuine issue of material fact existed as to driver’s negligence in Workers’ Compensation subrogation action – Mississippi State Agencies Self-Insured Workers’ Compensation Trust v. Herrgott, 369 So. 3d 563 (Miss. 2023);

  • Successfully obtained dismissal on behalf church, it’s pastor and other employees in suit brought alleging sexual harassment in the workplace – Eagan v. Vibrant Church, et al, No. 1:21-cv-149, 2022 WL 4360540 (N.D. Miss., September 20, 2022);

  • Successfully defended personal injury lawsuit through trial, resulting in a jury verdict awarding the plaintiff less than 3% of the damages sought (2023);

  • Obtained expungement of construction liens filed by general contractor and subcontractor on property owned by client pursuant to the Mississippi Construction Lien Law (2022);

  • Successfully appealed trial court’s order compelling arbitration pursuant to construction arbitration statutes where parties’ contract did not contain a valid arbitration provision – Hillhouse v. Chris Cook Construction, LLC, 325 So. 3d 646 (Miss. 2021);

  • Successful interlocutory appeal to the Fifth Circuit Court of Appeals resulting in certification of question to Mississippi Supreme Court as to the scope of a subrogation waiver in a fire loss claim. Following Mississippi Supreme Court’s ruling that a subrogation waiver operates as a blanket waiver of property damage to the extent property is covered by insurance, the Fifth Circuit reversed the district court’s ruling and rendered judgment in favor of client, dismissing the complaint – Liberty Mutual Fire Ins. Co. v. Fowlkes Plumbing, LLC, 934 F.3d 424 (5th Cir. 2019); 290 So.3d 1257 (Miss. 2020); 796 F. App'x 851 (5th Cir. 2020); aff’d, 850 F. App’x 213 (5th Cir. 2021);

  • Successfully defended farm equipment/tractor dealership in Breach of Contract, Breach of Warranty and Fraud lawsuit through trial, resulting in a complete jury defense verdict (2015);

  • Successfully defended personal injury lawsuit through trial, resulting in a jury verdict awarding the plaintiff 5% of the damages sought (2011);

  • Successfully defended national elevator manufacturer and its employee in personal injury lawsuit through trial, resulting in a complete jury defense verdict where plaintiff sought damages in excess of $1 million dollar insurance coverage limits (2010);

  • Successfully defended national intermodal transportation company and its driver in personal injury lawsuit through trial and appeal to the Firth Circuit Court of Appeals upholding complete jury defense verdict where damages sought were in excess of $2 million dollars – Kay Cranford v. Morgan Southern, Inc. and Christohper B. North, 421 F. App’x 354 (5th Cir. 2011); 333 F. App’x 852 (5th Cir.2009);

  • Successfully represented candidate for Justice Court Judge post in election challenge and appeal to the Mississippi Supreme Court where residency requirements for candidates seeking election to the position of Justice Court Judge was overturned – Montgomery v. Lowndes County Democratic Executive Committee, 969 So.2d 1 (Miss. 2007);

  • Successfully represented candidate for Sherriff in election challenge before county executive committee and full trial in Circuit Court through which results of election were overturned and new election was ordered (2001);
